Jackson County Executive Rejects 'Political Stunt' Anti-Gun Ordinance

Behind the scenes this move might REALLY be a flex against Legislator Manny Abarca and his ongoing feud with the Exec's office over stadium taxes, unspent COVID cash and personality clashes in general.

However . . .

What we know for certain is that many conservative residents of the county will support this effort even amid longstanding disagreements with the courthouse.

Jackson County Executive Statement on Ordinance 5865

KANSAS CITY, Mo. – Jackson County Executive Frank White, Jr. has released the following statement on Ordinance 5865 in response to a legal opinion from the Jackson County Counselor’s Office:
 
“Jackson County is committed to ensuring the safety and well-being of our residents, but we must approach this with integrity and respect for the rule of law. Ordinance 5865, currently pending before the Jackson County Legislature, seeks to restrict firearm possession for individuals aged 18-21. However, Missouri law is clear: this ordinance is unlawful and preempted by state law.
 
“The sponsor of this ordinance was fully aware of its legal shortcomings but chose to proceed. This is a dangerous disservice to our community.
 
“Passing Ordinance 5865 would not only be illegal and unenforceable but would also burden Jackson County taxpayers with the costs of defending an indefensible law. The inevitable legal battle will almost certainly result in Jackson County not only paying for its own legal defense but also covering the legal expenses and damages of the plaintiffs. Additionally, we would be handing a victory to the Attorney General’s Office which has a history of suing municipalities that attempt to impose such gun restrictions that violate state law.
 
"Our focus should be on real solutions that genuinely enhance public safety without misleading the public or wasting taxpayer money. We must reject political stunts that serve no purpose other than to deceive and divide our community. I commend the members of the Rules Committee today for holding Ordinance 5865 to review its legal implications. I urge the Legislature to ultimately oppose the ordinance and collaborate on lawful, effective measures to protect our residents.”
 
The County Executive addressed these concerns in a letter to the Legislature. A copy of the letter is attached, as well as the County Counselor’s legal opinion.
