100% the drivers fault. I work for a nearby railroad and these guys always put out the flares to slow traffic down. The low volume of rail traffic doesn't warrant any kind of lights or gates. She was traveling at a high rate of speed and disregarded the standard practice of marking the crossing with flares before moving.
