We've seen some social media chatter on this but so far he hasn't had to confront many criticism from candidates and only a bit of by-proxy nitpicking from the newspaper.
Accordingly . . . This is a big deal and something that most freshman KU students hit with the same kind of stringent charge would envy . . .To be fair, he wasn't driving and was simply catching a nap in his car after some beers at a law school get-together.

DeleteI was sure this dismissal was somehow going to take place. But 10:40 is correct it wouldn't have happened to your average citizen. The law in KS is very clear on how you can be charged. Insider tip I hear about from those who like to have a good time here and there is to place your keys in a hidden location not on the vehicle. Go take your nap and when sobered up go get your keys and go home. If fact a few who travel a lot say they do this when they pull over to grab a few zzz's in case a cop decides to wake them up. Being very tired and just awaken you may act like you're drunk when you're simply just trying to wake up and semi pissed that someone did such.

ReplyDeleteThe charge is colloquially referred to as "driving" under the influence, but really the offense is "operating" a vehicle under the influence, which is much broader. Being drunk in the driver's seat with the key in the ignition (not sure how that works with push button starters) is considered operating the vehicle.
ReplyDeleteThe story does not say whether the charge was dismissed as a result of a plea bargain, which would include pleading guilty to a much lesser charge and paying a fine. If there was no guilty plea to a lesser charge, then yes, he got celebrity justice.

So they assume they were driving or had the immediate intent to drive, or they should have had brain wave sensors and an uber interface implanted in their retina. Kansas courts have said this includes any “overt act to engage” and does not require movement of the vehicle. So while driving is sufficient for a conviction, it isn’t required.
If you get charged with a DUI in Kansas, you might be hoping to get the charge dismissed altogether. However, unless the court throws out evidence that’s critical to prove the charge, it’s unlikely a prosecutor will agree to a complete dismissal. Kansas statute prohibits reducing a DUI charge to a lesser offense, but a diversion agreement is sometimes possible.
So yes while Dave might not be right is saying Lucas should be charged with DUI in public, he also raises the question and states enough facts here that privilege conditions were applied here somehow. How often have we seen public officials skate away from these charges? Hell Kennedy killed a lady while drunk and got out of it. You and I would have been found guilty if Lawrence PD had charged us with such a charge.

There was no plea bargain. There was no diversion. There was no reason to arrest. There was no reason to charge. That's why there is no case. Yack it up all you want about whether it seems fair to you, but the guy was honest about it from the start, defended himself consistently in the court of public opinion, and ultimately got exactly what he deserved.
