ReplyDeleteFolks, it was a boat on a big lake in a violent storm. Shit happens. It’s like if I go ice skating and fall and cry about the ice being slippery and look around for someone to be held responsible for my own choice.
^That is too simplistic on your analogy. Liabilities get assigned by various factors. People PAID to ride this attraction as entertainment. Same as any service or product purchase, there are inherent obligations and liabilities.

Did you pay admission to skate at an established rink (not sneak onto a frozen farm pond)? A business has regulations and codes to abide.
Were the skates rented? The suitability, condition, and product safety history of the skates may be questioned.
Was the surface not inferior to what is reasonable for a rink to provide? Did rocks, other obstructions, or lack of resurfacing maintenance contribute to falling?
What was the lighting and visibility at the time of the fall? If the lights blinked off maybe a panic, a near collision, or an actual collision caused the fall.
Was there a sudden gust of wind during blizzard conditions? Outdoor rinks have exposure risks, and operators must use caution for patron safety.

Shouldn't need regulations to tell you to life vest up and get the fuck off a sinking boat. Sometimes people have to look out for themselves. Captain told them they didnt need life vests. Didn't tell them they couldn't wear them.
