ReplyDeleteThere will never be a conviction. Some my consider the statement to be incidiary, but it does not constitute a threat. I can say all day long that someone ought to have to swing from a tree for being a bitch. Now, if I say I am going to take someone and make then swing from a tree you might have a threat. Saying that you think someone should die a slow and painful death is not a threat. If you say you are going to cause someone to die a slow and painful death you might have a threat.

ReplyDeleteOf course, no court has EVER said that the Constitution gives anyone the right to carry a gun on a college campus or hospital. Even Scalia -- in his absurd "gun rights" opinion -- stated that any individual right to bear arms could be subject to reasonable restriction as to time, place and type. (For example, try to take a gun into the Supreme Court and you will do hard time.)
ReplyDeleteThis has NOTHING to do with the Constitution, but with a bunch of gunnuts in the legislature removing the rational restrictions that Scalia discussed to curry favor with the NRA and other gunnuts. Those Firearms Fetishists who think that having more guns makes things safer -- and cannot abide the imposition of rational thought on the subject -- because they equate their pistol with their penis.
