If you're suspected of driving while intoxicated, and refuse the breath analyzer, it means you'll now be subjected to a full series of field sobriety tests. The eyes don't lie...you're still busted you drunk douchebag!

The idea that any American would be threatened with jail or prison for exercising his rights under the constitution is just a step away from no constitutional protections at all.
ReplyDeleteSome of these shit heels honestly believe that if a cop or the state wants to eliminate constitutional law and walk all over a citizen it is just fine. Some need to reed the Federalist Papers and constitution and grasp just how much the forefathers wanted free people to be protected from government overreach and abuse. For the, so called, do gooders, I'd suggest that every time you violate an ordinance or law you do your duty and run down to the police department and turn yourself in. or your wives, your children, your neighbours, parents, etc. Who knows, if we adapt your perspectives not attending weekly government confession may be a felony some day.
If a cop thinks I have had too much to drink then I will submit to a blood test and only that. Their side of the road gymnastic crap and trying to blow one of my ear drums out with a blow test is shit thy can stick up their ass.
ReplyDeleteBut before said test I'm making the accusing officer sign a piece of paper I carry saying they will pay for said test if I am legally sober and that I am volunteering to take said test.
But I know I can have two drinks and am ok. Any more than that and I feel it, so I know my limits and abide by them. If I want to get shit faced, I stay home and do it or the wife does the driving.
I agree that field sobriety tests are bullshit and so is putting me in jail for refusing one. Now you may take my license since that is apparently an administrative and not a punitive action, but the question remains as to how a field sobriety test is a valid measure of intoxication when it is impossible to measure someones blood alcohol level when they are standing on one foot clucking like a chicken.
ReplyDeleteThe DUI statutes do not say you have to be able to walk, stand on one foot, follow and ink pen with your eyes or recite the alphabet backwards or do a pile of things dreamed up by some shit heel to be valid tests of sobriety. The statutes specifically specify an amount of blood alcohol required for a driver to be impaired or intoxicated. Any test that fails to determine that is complete bullshit and is more about a dog and pony show in the courtroom than actual evidence of intoxication or impairment.
