Jackson County Prosecutor Jean Peters Baker released the following statement today regarding a St. Louis circuit ruling that a convicted felon was within his rights to be armed under a Missouri Constitutional Amendment 5 passed last year.
Politics or public safety?
About a year ago, my office and others warned Sen. Kurt Schafer and the Missouri General Assembly that a then-proposed Constitutional Amendment could raise new, deadly concerns for law-abiding citizens.
Now, I’m disheartened to see that those warnings may be coming true. A Circuit Judge in St. Louis ruled today that the state cannot prohibit a felon from possessing firearms. The judge cited the new constitutional language as the basis for his decision.
Everyone should agree that more guns in the hands of more criminals will only equal more violence.
If prosecutors lose the ability to prosecute felons in possession of firearms, more gang members, drug dealers and domestic abusers – the persons responsible for most of the shootings in our communities -- will be allowed to carry guns.
The Missouri General Assembly broke this. Now they need to fix it. It’s time to choose protecting public safety over politics.

Making a law that says they can't have guns will be ignored so mean Jean just stick to putting the assholes in jail where they will be for more than say twenty years instead of the 90 day bullshit you are good at doing.

ReplyDeleteGranted, convicted criminals that use a fucking gun to commit a crime should lose their gun rights. BUT, someone who got caught with a small amount of weed should not lose their right to own a gun.
Simple, if you use a gun to commit a crime, you lose your gun rights. Otherwise, leave peoples gun rights alone.

DeleteI'm a convicted felon (3 dui's).last one was in 2000.I have no violence on my record.nobody was hurt in my dui's ,except for me,financially.
ReplyDeleteI quit drinking over 7 yrs ago,been I'm no trouble since. I would love to have my rights restored. I work and travel in dangerous parts of the city. Feel like a sitting duck at times.I carried for awhile but made me too nervous,that whole 5 years in prison thing.
I think that I have paid dearly for my stupid,dangerous behavior. A guy like me and there are plenty others would pose no threat to society.
It's still a federal offense.
ReplyDeletePerhaps 942. Everyone wants the rules to be reflective of their own particular circumstances. problem is, regulations can't be deigned in a manner that addresses every particular instance.
ReplyDeleteGood friend of mine got a DUI when he was about 25. NEVER came close to drinking and driving again. The punishment worked.
Problem is, for others, they become repeat offenders. Addressing both types of behavior with differing laws becomes very difficult.
Just like standard procedure in Jackson County, the feds will take up the slack and fed time is a lot longer than state.

ReplyDeleteThe latest round of gun legislation in Missouri was a complete clusterfuck and the legislation is unconstitutional. All you have to do is read the amendment damn near everyone voted for. The additional problem with the current jacked up statutes is this: Lets say 30 years ago when a felony was $50.00 in damage or theft you broke out a window as a 13 year old. You went to juvenile court and pled guilty. Now under the present screwed up law you can never posses a firearm for the rest of your life - not because you were adjudicated as a juvenile offender, but because you Plead guilty to a felony. If you had pled innocent and then were adjudicated you could legally posses all the firearms you want because a juvenile adjudication was not a conviction. To add to the mess today we take those felons (now over $500.00) and put them on a myriad of flavors of diversion type programs where they aren't even found guilty or adjudicated as felons. So the juvenile who pleads guilty gets screwed and the guy who did it and fights gets to own weapons even if he looses. Now add to it that there is no was a kid 30 years ago could have possibly known that he could be at risk again in 30 or 40 years becasue of some stupid ass game the politicians are playing in Jeff City.
